    القضاء المغربي ينتصر لساكنة “حومة الشوك”

    قضت الغرفة الاستعجالية التابعة لابتدائية طنجة، اليوم الاثنين 20 نونبر الجاري، بعدم قبول دعوى طرد ساكنة حي بنكيران، وسط فرحة عارمة للعشرات من سكان “حي بنكيران”، الذين احتشدوا أمام المحكمة بأعداد غفيرة.

    وكانت قضية عقارية شائكة قد تفجرت مؤخراً بمدينة طنجة ، بعدما وضعت شركة عقارية ، دعوى قضائية استعجالية امام المحكمة الإبتدائية لإفراغ ساكنة أكبر الأحياء الشعبية بالمدينة و يتعلق الأمر بحي بنكيران “حومة الشوك”.

    و تقول الساكنة التي تبلغ حوالي 800 أسرة ، وتمثل نسبة 90 في المائة من ساكنة حي “حومة الشوك”، أنهم يقطنون بمنازل لمدة تزيد عن 70 سنة ، و بين ليلة و ضحاها تظهر شركة عقارية تطالب بطردهم بشكل إستعجالي من مساكنهم بحجة أن هذه الأرض كانت ملكاً لوالده.

    وحسب المقال الاستعجالي المرفوع لرئيس المحكمة الابتدائية بمدينة طنجة، فإن الشركة التي تحمل اسم “شرف إيموبيليي”، تدعي أنها المالكة للرسم العقاري G/8125، وتبلغ مساحته 14 هكتار آر 46 سنتيار مكونة من أرض عارية بناء على شهادة الملكية.

    وطبقا للمصدر ذاته، فإن الشركة المذكورة، وبعد تفقد العقار، تفاجأت باحتلاله من دون أي سند قانوني، ليقوم محاميها برفع دعوى استعجالية في الموضوع.

    ولكون المدعى عليهم لا تربطهم بالشركة المعنية أي عقود كراء أو شراء، طالب محامي الشركة بطردهم بشكل استعجالي.

    مصادر قالت أن القضية التي تفجرت بطنجة ، لا تهم المساكن فقط ، بل هناك من أقام مشاريع على الأرض الموجودة حاليا رهن النزاع ، بما فيها محلات تجارية و مقاهي.
