وتشير الورقة التي تحمل عنوان “التونسيات في حاجة عاجلة لتعديل قانون العمل” إلى أن عدم إقدام مجموعة من دول منطقة الشرق الأوسط وشمال إفريقيا، من بينها تونس، على تعديل الفصول التي تحول دون ولوج النساء لقطاع المعادن والمقالع، يحد من قدر تهن على الاندماج الاقتصادي، ويقلّل من فرصهن في إيجاد شغل قار. وأكدت الورقة إلى أن تأخر المُشَرِّعِ التونسيفي أخذ هذه الخطوة يقود إلى تكريس الصورة النمطية التي تحصر إمكانيات عمل النساء في القطاعات الخدماتية، والتي تتخذ من ذريعة محدودية قدراتهن الجسمانية التي لا تساعدهن على العمل في قطاعات مثل قطاعات المعادن تبريراً لها.
في نفس السياق، تطرّق الدكتور رشيد أوراز، صاحب الورقة، إلى وضعية المرأة التونسية في سوق العمل. فبناء على الأرقام المعروضة المستوحاة من معطيات البنك الدولي وأرقام رسمية تونسية، أشارت الورقة إلى محدوديةقدرة السياسات الاقتصادية التونسية في توفير فرص شغل إضافية قادرة على امتصاص الارتفاع الملحوظ في نسبة النساء القادرات على العمل. واستندت الورقة على معدلات البطالة المرتفعة في صفوف النساء التونسيات، حيث “يبلغ حوالي 22,2 في المائة سنة 2022، وظلّ مستقراً فوق عتبة 20 في المائة منذ أكثر من 12 سنة“.
من جهة ثانية، قدّمت الورقة مقارنة بين حصة التشغيل في صفوف الذكور والنساء لتظهر الفوارق الجندرية على مستوى فرص العمل. فعلى صعيدبنية سوق الشغل، أوضحت بيانات البنك الدولي ومنظمة العمل الدولية والمؤسسات الوطنية التونسية التي استندت عليها الورقة أن “حصة التشغيل في صفوف الرجال هي ضعف حصة التشغيل في صفوف النساء بحوالي ثلاث أضعاف، وبقي هذا الواقع مستمرا لما يفوق أكثر من 3 عقود من الزمن“. وفسّر الدكتور رشيد أوراز “بأن هذه الأرقام تبين أن عجز الاقتصاد والسياسات التونسية في منح مزيد من الفرص للنساء، إنما هو مسألة بنيوية لا ترتبط بظرفية معنية، كالظرفية التي تلت الثورة التونسية والتي تتميز بعدم الاستقرار وتراجع الفرص أمام الجميع“.
وبناء على هذا، اعتبرت الورقة أن التعديل ضروري لكل من المادة 77 التي تنص على أنه “لا يجوز تشغيل النّساء مهما كانت سنّهن والأطفال دون الثمانية عشر عاما بأعمال تحت الأرض في المناجم والمقاطع“، والمادة 78 التي تشير إلى أنه “يحجّر استخدام الأطفال دون الثمانية عشر عاما والنسوة أو الموافقة على تشغيلهم بالمؤسسات وأقسام المؤسسات أو الحظائر التي تجرى بها عمليات استرجاع المعادن القديمة أو تحويلها أو إيداعها“، ونظيرتهم المادة 375 التي تؤكد بأنه “يمكن أن تقتضي قرارات مشتركة بين كاتبي الدولة للشباب والرياضة والشؤون الاجتماعية وللتخطيط والاقتصاد الوطني شروطا خاصة للترخيص للنسوة والأطفال الذين سنهم دون السادسة عشرة عاما في القيام بأشغال فلاحية قد تنجرّ عنها أخطار خاصة“. فبالإضافة إلى أنها وضعت المرأة في مستوى واحد مع الأطفال في تقليل وتنقيص لقدراتهن، حرمت هذه المواد النساء من فرص عمل إضافية من جهة، ومن حلول اقتصادية للفاعل الاقتصادي التونسي من جهة ثانية.
وعليه، خلصت الورقة إلى أن هذه التعديلات ستنعكس بشكل إيجابي على الحالة التونسية بشكل عام. فتحديث الترسانة القانونية سيمكّن النساء من مصادر دخل قارة، ويساعد في تحقيق مبدأ المساواة بمنح النساء حق العمل الشامل. أما على المستوى الاقتصادي، استشهدت الورقة بتقرير التنمية في العالم لعام 2012 الذي أكد بأن إزالة هذه الحواجز ساهم في زيادة إنتاجية بعض القطاعات بنسبة تتراوح بين 13 إلى 25 في المائة في البلدان المدروسة.
